Trovela Company and/or its subsidiaries, affiliates, through its sponsored platform "Nessa", provides website, mobile app and other products and services to you when you visit, download, book, check in, check out, chat, access content, and use Nessa products/services or use software provided by Nessa in connection with any of the foregoing (collectively, "Nessa Technologies"). Nessa provides its services under the following conditions.

We offer a wide range of services, and sometimes additional terms may apply. When you use our service you also will be subject to the Disclaimer, Content Guidelines and Terms & Agreements applicable to that Nessa Service ("Service Terms"). If these Terms of Use are inconsistent with the Service Terms, those Service Terms will prevail.
If you do not wish to be bound by this agreement, do not access the Nessa websites or download the mobile application.

Nessa is designed in such a way that nobody on this platform will have access to your personal data and information only if you willfully share such information with them. Example: your personal phone number, email address, resident address and social media handles.

We made an in-app call, so you don’t have to give your personal contact unless you are sure that is what you want to do.

Your personal information when you create a Nessa account and personal information used to list properties are safe with Nessa. Your personal information will be demanded when you are to book a property and check-in, which might be booked for yourself or someone else.
Nessa host will not by any means share your personal information with anyone, and Nessa will not share your personal information on claims unless you authorize such a transaction.

When you use Nessa Services, text messages, and other communications from mobile devices to us, you may be communicating with us electronically. You consent to receive communications from us electronically, such as emails, texts, mobile push notifications, and messages on this app or through the other Nessa Services, such as our Customer service portals, and you can retain copies of these communications for your records. You agree that all agreements, notifications, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

All content included in or made available through any Nessa Service, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software is the property of Nessa or its content suppliers and protected by Nigerian and copyright laws. The compilation of all content included in or made available through any Nessa Service is the exclusive property of Nessa and protected by Nigerian and international copyright laws.

In addition, graphics, logos, page headers, button icons, scripts, and service names included in or made available through any Nessa Service are trademarks of Nessa in Nigeria and other Countries. Nessa's trademarks cannot be used in connection with any product or service that is not Nessa's, except with the prior written consent of Nessa Technologies. All other trademarks not owned by Nessa that appear in any Nessa Service are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Nessa.

One or more patents owned by Nessa apply to the Nessa Services and to the features and services accessible via the Nessa Services. Portions of the Nessa Services operate under the license of one or more patents.

Subject to your compliance with these Terms & Conditions, Nessa Content Guidelines and any other Service Terms, and your payment of any applicable fees, Nessa or its content providers grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the Nessa Services. This license does not include any resale or commercial use of any Nessa Service, or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of any Nessa Service or its contents; any downloading, copying, or other use of account information for the benefit of any third party; or any use of data mining, robots, or similar data gathering and extraction tools. All rights not expressly granted to you in these Terms of Use or any other Service Terms are reserved and retained by Nessa or its licensors, suppliers, publishers, rights holders, or other content providers. No Nessa Service, nor any part of any Nessa Services, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of Nessa. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Nessa without express written consent. You may not use any meta tags or any other "hidden text" utilizing Nessa's name or trademarks without the express written consent of Nessa. You may not misuse the Nessa Services. You may use the Nessa Services only as permitted by law. The licenses, if any, granted by Nessa terminate if you do not comply with these Terms of Use or any other Service Terms.

You need your personal Nessa account to use certain Nessa Services, and you are required to be logged in to your Nessa account to preview people’s profiles, swipe, chat, and have a valid payment method associated with it. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account password and PIN. Nessa only sells products for adults, who can purchase with a credit/debit card or other permitted payment method. Nessa accounts are only user by individuals from age 18 and above, minors caught using these services will be prosecuted by law, you may use the Nessa Services only with the involvement of a parent or guardian. Everything sold on Nessa is intended for adults from 18 and above. You must be at least 21 years of age to purchase alcohol or use any site functionality related to alcohol. Nessa reserves the right to refuse service, terminate accounts, terminate your rights to use Nessa Services, remove or edit content, or cancel orders in its sole discretion.

Public exposure of private parts as an adult, either individual or group media on Nessa is considered offensive. Nessa reserves the right to refuse service, terminate accounts, terminate your rights to use Nessa Services, remove or edit content, or cancel transactions in its sole discretion.

If your subscription involves a recurring payment of a fee unless you notify us before a charge that you want to cancel or do not want to automatically renew your membership or subscription, you understand it will automatically continue and you authorize us (without notice to you) to collect the then-applicable fees and any taxes using any other payment method we have on record for you.

If we are unable to charge you for the renewal of your subscription through any of the payment methods that we have on file for you, we may cancel your subscription, as applicable, unless you provide us with another payment method. If you provide us with a new payment method and are successfully charged before your membership or subscription is canceled, your new membership or subscription period will be based on the original renewal date and not the date of the successful charge.

You may cancel your membership plan and any subscriptions anytime you feel like. If you cancel your membership or subscription, you will not receive a refund of any fees already paid. Your member benefits terminate when your membership is canceled, but cancellation does not terminate your license and access to purchased goods or services or use other services of Nessa.

You may post reviews, comments, photos, videos, and other content; send e-cards and other communications; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights (including publicity rights), or otherwise injurious to third parties or objectionable, and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam" or unsolicited commercial electronic messages. You may not use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. Nessa reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.

If you do post content or submit material, and unless we indicate otherwise, you grant Nessa a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Nessa and sublicensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Nessa for all claims resulting from content you supply. Nessa has the right but not the obligation to monitor and edit or remove any activity or content. Nessa takes no responsibility and assumes no liability for any content posted by you or any third party.

All purchases, bookings, and listings from Nessa are made pursuant to Nessa as a platform provider. This means that the risk of loss is between the host and the guest. Nessa will only intervene when involved. It’s vital to provide accurate contact information, and the rest will be resolved by the host.

Nessa encourages refunds when a property does not meet all requirements and does not suit the purpose of the pay. A refund has rules of engagement which include fees and fines paid over a period of time. For more information about our refunds, please see our Refund Policy.

Nessa attempts to be as accurate as possible, by enforcing hosts to post as many details of the properties as possible. However, Nessa does not warrant that product descriptions or other content of any Nessa Service are accurate, complete, reliable, current, or error-free. If a property offered by Nessa itself is not as described, your sole remedy is to ask for a refund in untampered condition.

Products and prices are provided by hosts and are not negotiable. Nessa does not own any property on the listing, products, and prices are provided by hosts and partners.
From time to time, prices and promo deals may be introduced by hosts and partners.
Each property and partner has its own terms of pricing and discounts.

When you use apps created by Nessa, such as the Nessa App, you may grant certain permissions to us for your device. To make use of Nessa permission to gain access to some vital aspect of your phone is required.
Location Services, this enables you to be found by other users and also enables other users to find you.
Media Files, this enables you to gain access to your media files, for listing property pictures and uploading for gallery use.
Notification, this enables you to get notifications of chat messages, transactions, bookings, check-in and check-out.

You may not use any Nessa Service if you are the subject of Nigerian sanctions or of sanctions consistent with Nigerian law imposed by the governments of the country where you are using Nessa Services. You must comply with all Nigerian or other export and re-export restrictions that may apply to goods, software (including Nessa Software), technology, and services.

Nessa is only available to African users, whereas users who sign up from other parts of the world will not get the best out of Nessa services because of the unavailability of our services in those continents.

Nessa and all information, content, materials, products (including software), and other services included on or otherwise made available to you through the Nessa services are provided by Nessa on an "as is" and "as available" basis unless otherwise specified in writing. Nessa makes no representations or warranties of any kind, express or implied, as to the operation of the Nessa services, or the information, content, materials, products (including software), or other services included on or otherwise made available to you through the Nessa services, unless otherwise specified in writing. You expressly agree that your use of the Nessa services is at your sole risk.

To the full extent permissible by law, Nessa disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Nessa does not warrant that the Nessa services, information, content, materials, products (including software), or other services included on or otherwise made available to you through the Nessa services, Nessa's servers, or electronic communications sent from Nessa are free of viruses or other harmful components. To the full extent permissible by law, Nessa will not be liable for any damages of any kind arising from the use of any Nessa service, or from any information, content, materials, products (including software,) or other services included on or otherwise made available to you through any Nessa service, including, but not limited to direct, indirect, incidental, punitive, and consequential damages, unless otherwise specified in writing.

Any dispute or claim relating in any way to your use of any Nessa Service, or to any products or services sold or distributed by Nessa or through getnessa.com will be resolved by binding arbitration.

We reserve the right to make changes to our site, policies, Service Terms, and these Terms of Use at any time. Trovela Company uses Third-Party API services and by signing up to this Service, you agree to be bound by the Terms and Policies applicable and/or governing Third-Party content. Links to Third-Party websites and online services that may be contained in these Terms are not owned or controlled by Trovela Company. Therefore, Trovela Company makes no representation and assumes no liability or responsibility for the content, privacy policies, or practices of these third-party Services, or the accuracy, reliability, or correctness of those services.

No Reverse Engineering.

You may not reverse engineer, decompile or disassemble, tamper with, or bypass any security associated with the Nessa Software, whether in whole or in part.

Updates.

We may offer automatic or manual updates to the Nessa Software at any time and without notice to you.

Government End Users.

If you are a Nigerian Government end user, we are licensing the Nessa Software to you as a "Commercial Item" as that term is defined in the applicable Laws of the Federal Republic of Nigeria and the rights we grant you to the Nessa Software are the same as the rights we grant to all others under these Terms of Use.

Conflicts

In the event of any conflict between these Terms of Use and any other Nessa or third-party terms applicable to any portion of Nessa Software, such as open-source license terms, such other terms will control that portion of the Nessa Software and to the extent of the conflict.
